Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to amputation hazards created by the operation of power press
brakes with
unprotected treadle/pedals.
a) Shop - On or about 10/18/11 employees operated the Wysong power shears
and no protective
device was installed to prevent the accidental activation by falling or
moving objects, or by
human error.
Abatement method: Among other methods, a feasible and acceptable abatement
method to
correct this hazard is to provide a safety device for the treadle/pedal
that meets the requirements
of ANSI B11.3-2007 section 6.10.4 Safety Requirements for Power brakes,
which states: When
provided, foot controls shall be protected to prevent actuation from
falling
or moving objects,
or from unintended activation. 1) You are not limited to the abatement
methods suggested above.
2) The methods explained are general and may not be effective in all
cases. 3) The employer
is responsible for selecting and carrying out the appropriate method.
In accordance with 29 CFR 1903.19(c), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
