Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire hazards created by the incompatible storage of flammable liquids and organic peroxides. (a) Location - Warehouse 1, 400 Main Street, Tewksbury, MA: On or about 10/5/11, employees were exposed to fire hazards due to improper storage of organic peroxides near flammable liquids and other combustible material. NFPA 400 and material safety data sheets require that strong oxidizing agents such as organic peroxides be kept separately from flammable liquids. Among other methods, one feasible and acceptable abatement method to correct the hazard is to create a storage area that complies with NFPA 400 and train employees on the proper storage, use and handling of organic peroxides.
