Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of confined spaces: At the construction site the employer did not a) Promptly guard the opening to the centrifugal feed pump room when the doors were opened with a railing, temporary cover, or other temporary barrier that would have prevented an accidental fall through the opening and that would have protected each employee working in the space from foreign objects entering the space. b) Test the internal atmosphere before an employee entered the space, with a calibrated direct-reading instrument, for oxygen content, for flammable gases and vapors, and for potential toxic air contaminants, in that order. c) Certify that the space was safe for entry and that the pre-entry measures had been taken, through a written certification that contained the date, the location of the space, and the signature of the person providing the certification. The certification was not made before entry. d) Certify that the all affected employees received training in confined space entry procedures. The certification shall contain each employee's name, the signatures or initials of the trainers, and the dates of training. Thereby exposing the employees to the hazards of oxygen deficiency, chemical poisoning and/or dangerous accumulation of toxic gases, such as but not limited to hydrogen sulfide and methane while replacing the pump and piping inside the pump room on or about November 12, 2011. Among other methods, one feasible and acceptable method to correct these hazards would be to: (a)Meet the requirements of 29 CFR 1910.146(c)(5)(ii)(B) Install railings or barriers around open entrances to confined spaces. (b)29 CFR 1910.146(c)(5)(ii)(C) test the air with a calibrated direct self reading instrument. (c)29 CFR 1910.146(c)(5)(ii)(H) Prepare a written certification that the space is safe for entry and that the pre-entry measures required by 29 CFR 1910.146(c)(5)(ii) have been taken, the certification must contain the date, the location and signature of the person making the certification. (d)29 CFR 1910.146(g)(4) Certify that training required by 29 CFR 1910.146(g)(1) through (g)(3) have been accomplished. The certification shall contain each employees name, the signatures or initials of the trainers and the dates of the training. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
