Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to respiratory hazards: a)Engine Room: On or about October 25, 2011, the employer did not ensure that employees were protected from hazards associated with inhalation of ammonia. The engine room which housed the six ammonia compressors was not equipped with a means to detect possible ammonia leaks. Among others, one feasible abatement method is to install a minimum of one ammonia detector connected to a supervised alarm as required by the American National Standard for Equipment, Design, and Installation of Closed-Circuit Ammonia Mechanical Refrigeration Systems, ANSI/IIAR 2-2008, Section 13, Machinery Room Design, Section 13.1.1.2 "All machinery rooms shall be equipped with at least one ammonia detector connected to a supervised alarm". .
