Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: a)In the Layout area of the facility: On October 31, 2011 and at times prior to, the employer failed to provide a static or dynamic load test for the 1 ton, under-hung crane that was using a hook block that was designed for a wire rope and attached to the lifting chain by a bolt and nut, exposing the operator to crushing hazards from a falling load. A feasible means of abatement would be to follow the instructions provided in the American National Standard, ANSI B30.16 (1998) para. 16-2.2.2, that requires a static or dynamic load test when parts have been replaced repaired or altered.
