North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck or crushed by hazard: a)1401 Hargett Street, Jacksonville, N.C. ground level - where an employee left a JLG Lull (Model 644E-42 Serial Number 0160026007) rough terrain forklift truck unattended with the lifting mechanism forks approximately four feet from the ground. b)1401 Hargett Street, Jacksonville, N.C. roof level - where subcontracted employees left a JLG Lull (Model 644E-42 Serial Number 0160026007) rough terrain forklift truck unattended with the lifting mechanism forks approximately two feet from the surface of the roof. Among other methods, one feasible and acceptable abatement method to correct this hazard is to retrain the employee on safe rough terrain forklift operation practices.
