North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a)back storage room - where employees were working adjacent to a damaged section (bent upright) of shelving that contained cases of motor oil weighing 382 lbs stored 8' above the ground. Among other methods, one feasible methods to correct this hazard is to remove the load from the shelf, and replace the bent upright.
