Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a)Employee(s) using an elevated work platform to check the inventory in the upper storage racks of the warehouse were exposed to a fall hazard of approximately 15 feet due to no personal fall protection equipment being provided for the employee inside the elevated work platform. The elevated work platform was hoisted from ground level by a forklift. (b)Employee(s) using an elevated work platform to check the inventory in the upper storage racks in the warehouse were exposed to fall hazard of approximately 15 feet due to a broken clasp on the chain used to secure the elevated platform to the forklift. The broken clasp does not provide an effective means to prevent the elevated platform from falling off the forks of a forklift, when hoisted from ground level. Among other methods, one feasible and acceptable method to correct this hazard is to provide personal fall protection equipment for the employee(s) inside the elevated work platform and a safety chain to secure the work platform without defects as prescribed in section 4.17.2 of ANSI B56.1-2009, Safety Standard for Low Lift and High Lift Trucks. 29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is completed.
