Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing, or likely to cause, death or serious physical harm to
employees in that employees
were exposed to tip over hazards while operating high lift fork lift
trucks in locations not
suitable for the use of high lift fork lift trucks:
At and around the front entrance of this facility, a contract employer was
permitted to operate a Mitsubishi, stand-up fork lift truck, model ESR 36,
serial
number IESR360789, outdoors on a sidewalk in close proximity to a wet,
grassy.
area. A wheel of the fork lift truck rolled onto the wet grass area and
sunk,
resulting in a tip over of the fork lift truck.
Among other methods, one feasible means of abatement to correct this hazard
would be to obtain appropriate equipment, such as, but not limited to, an
aerial
lift or a scissor lift, to perform the sign maintenance work.
