Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing, or likely to cause, death or serious physical harm to
employees in that employees
were exposed to struck-by hazards:
At the employer's yard, incoming operators of truck and trailer rigs were
permitted to assist in the cribbing, loading, and securing of cargo onto
trailer
flatbeds. While working in the employer's yard the truck operators were
exposed
to falling loads and being struck by cargo being loaded and by cargo
potentially
being struck by the fork lift trucks and knocked off the trailer and
striking the
operator standing near- by.
Among other methods, one feasible and acceptable method of preventing
recurrence of this type
of incident is establish and enforce safety programs, policies, and
procedures
to control incoming
truck drivers during loading operations.
