North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by moving vehicles: a) Sweet potato field on Emma Cannon Road in Ayden, NC - employees were assigned to work in a sweet potato field in close proximity to moving vehicles and inadequate steps were taken to protect employees from being struck by those vehicles. On 11/12/12, one employee died after being struck by a truck while harvesting sweet potatoes. ABATEMENT NOTICE: Among others, one feasible and acceptable method of abating this violation is to establish safe work zones for employees working near moving vehicles. In addition, take appropriate precautions when vehicles are backing up, including but not limited to; assigning a spotter to help drivers back up their vehicles, and/or installing video cameras with in-vehicle display monitors, and/or installing proximity detection devices to alert drivers to objects that are behind them.d
