North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to-Fall to lower level: a)site address-a work local made work platform where an employee was working, was not securely mounted to the forks of the Dieci XMR6.221 model all terrain fork lift, was not securely attached to the forks. (ref para 5.15.1(b) ANSI/ITSDF B56.6-2011) b)site address-the forks of a Dieci XMR6.221 model all terrain fork lift, did not have the controls secured to prevent them from pivoting upward. (ref para 5.15.1(c) ANSI/ITSDF B56.6-2011) c)site address-the local made work platform from which an employee was working and riding in, at a height of approximately 18 feet, was not provided with anchor points for personal fall protection devices. (ref para 5.15.1(k) ANSI/ITSDF B56.6-2011) ONE FEASIBLE MEANS OF ABATEMENT IS TO COMPLY WITH THE STANDARDS WHICH APPLY TO THIS TYPE OF OPERATION.
