Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:06/19/13 Condition:An employee was exposed to drowning while supervising maintenance and inspection activities on a rotating/pivotal bridge located 6 feet above water having a depth as great as 22 feet when the employer did not ensure the use of life jackets. (b)Date of Violation:06/19/13 Condition:An employee was exposed to drowning while supervising maintenance and inspection activities on a rotating/pivotal bridge located 6 feet above water having a depth as great as 22 feet when the employer did not ensure the use of a boat/skiff. (c)Date of Violation:06/19/13 Condition:An employee was exposed to drowning while supervising maintenance and inspection activities on a rotating/pivotal bridge located 6 feet above water having a depth as great as 22 feet when the employer did not ensure the use of a life ring. Among other methods, one feasible means and acceptable abatement to correct this hazard is to follow the Federal Highway Administration, Bridge Inspector's Reference Manual, (BIRM), Chapter 2.2, pages 2.2.5, Life Jackets, and page 2.2.8, Boat/Skiff and Life Ring. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
