employment which were free from recognized hazards that were causing or
likely to cause death or serious
physical harm to employees:

Condition:A refuse truck with employees riding on the rear of the truck,
crossed the double
yellow line of a major four lane roadway.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is for the
employer to ensure that the operator/employee operating a truck on a major
road do not cross the double
yellow line or wrong side of the road to make it easier for laborers to
collect trash and/or recycling materials
as per the Maryland State Transportation Law Section 21-301(c)(1) which
state "On any roadway, that is
divided into four or more clearly marked lanes for vehicular traffic and
provides for two-way movement of
traffic, a vehicle may not be driven on the left side of the centerline of
the roadway" and per the employer's
supplemental procedure for residential trash collection which states
"Drivers are required to collect trash and
recycling on the correct side of the road. It is not permissible to drive
on the other side of the yellow line (or
wrong side of any major road) in order to make it easier for laborers to
pick up trash and/or recycling
materials."
