North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from elevation: a)facility, where employees were exposed to fall hazards at heights up to nine (9) feet due to the method of assembling the pallet racks while standing within the same rack. b)facility, where employees were climbing down the ends of the racks once assembled from heights of or exceeding nine (9) feet. Among other methods, one feasible method to correct this hazard is to assemble the pallet racks from a scissor lift.
