OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, the use of seat belts by employees operating forklifts was not enforced, exposing employees to crushing injuries in the event of a forklift tip-over or other accident: On or about June 30, 2011, an employee operating a Nissan powered industrial truck, in the shipping department, was not wearing a seat belt; exposing them to serious injuries in the event of a tip-over or other accident. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").

29 CFR 1910.23(a)(1): Every stairway floor opening was not guarded by a standard railing constructed in accordance withparagraph (e) of this section. The railing shall be provided on all exposed sides (except at entrance to stairway). For infrequently used stairwayswhere traffic across the opening prevents the use of fixed standard railing (as when located in aisle spaces, etc.), the guard shall consist of ahinged floor opening cover of standard strength and construction and removable standard railings on all exposed sides (except at entrance to stairway): On or about March 29, 2011, and at times prior, the stairway floor opening on a second floor storage area was not guarded, exposing employees to fall hazards in excess of10 feet.
