OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, the use of seat belts by employees operating forklifts was not enforced, exposing employees to crushing injuries in the event of a forklift tip-over or other accident: (a) On or about November 7, 2014, an employee operating a Toyota powered industrial truck in the sheet metal area and outside the building on the east side, was not wearing a seat belt. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet"). Garmat USA, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard OSH Act of 1970 Section (5)(a)(1) which was contained in OSHA inspection number 29067, citation number 1, item number 1, and was affirmed as a final order on October 11, 2011, with respect to a workplace located at 1401 W.
