29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8m) or more above lower levels were not protected by guardrail systems, safety net system, personal fall arrest system, or other approved alternative fall protection system: (a) CDC Development Company at Broadway St & Poplar Ave, Boulder, CO 80304: On and before April 29, 2011, the controlling employer did not ensure that subcontractor employees were protected from injury, in that six subcontractor employees erecting exterior walls on top of the 2nd level of a three-story townhome complex were not utilizing a fall protection system. Subcontractor employees worked near the unprotected edge during this process, in addition to working at the edge while performing other framing work. This condition exposed the workers to a fall hazard of approximately 21 feet to the ground below. (b) CDC Development Company at Broadway St & Poplar Ave, Boulder, CO 80304: On and before April 29, 2011, the controlling employer did not ensure that subcontractor employees were protected from injury, in that two subcontractor employees were not utilizing a fall protection system while working at the unprotected edge on top of the 2nd level. The subcontractor employees were unloading framing material from a rough terrain forklift at this location. This condition exposed the workers to a fall hazard of approximately 21 feet to the ground below.
