29 CFR 1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a)Castillo Roofing LLC, 143 Mesa Street, Brighton, CO: Employees replacing existing composit roof shingles were doing so without wearing hardhats. On or about April 18th, 2011, employees were observed dropping scrap shingles from the second story of the single family home while other worked below. Condtion exposed employees to a "struck by" injury. Abatement Note: Abatement certification is required for this item (See enclosed Abatement-Certification Letter).

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person a) Castillo Roofing, LLC, 143 Mesa Street, Brighton, CO: The employer had not ensured that frequent inspections of the jobsite were conducted by a competent person to determine that appropriate fall protection was installed prior to removing and installing new singles on the 2 story residence. On or about April 18th, 2011, employees installing singles on the 6/12 pitch roof were not utilizing appropriate fall protection. Condition exposed employees to a fall hazard of approximately 18 feet. Abatement Note: OSHA defines a competent person as someone capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
