CFR 1926.501(b) (10):  Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system;    	(a)	MK Roofing Inc. 4550 East Jewell Avenue, Denver, CO 80222:  On and before May 17, 2011, two employees working on a flat roof located at 4550 East Jewell Avenue, Denver, CO were not protected from falling by a system as described above.  Specifically, an employee was witnessed and photographed leaning over the edge of the flat roof to assist another employee who was on the ground lift equipment and electrical power cords to perform some roofing work.  Condition exposed employee to fall hazards of over 40 feet.    Abatement Note:  Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Letter").

CFR 1926.503(a)(1):  The employer failed to provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.    	(a)	MK Roofing Inc., 4550 East Jewell Avenue, Denver, CO 80222:  On and before May 17, 2011,  employees were witnessed working off a three story flat roof without adequate fall protective measures in place.  The fact that employees had adequate fall protective measures on site yet failed to utilize them and additionally were working unsafely off a roof at over three stories and seen leaning over the sides to raise equipment, point to a lack of training. Condition exposed employee to fall hazards of over 40 feet.    Abatement Note:  Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Letter").
