29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):    (a) Walsh Construcition, Inc. @ 1900 Longs Peak Ave., Longmont, CO 80501:  On and before May 24th, 2011,  the employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees and subcontractor on-site were permitted to work in areas where fall hazards existed. The condition exposed employees and subcontractor employees to fall hazards of approximtately 13'5" on the north side of the roof and approximately 11 feet on the east side of the roof.

(a)Walsh Construction, Inc. @ 1900 Longs Peak Ave., Longmont, CO 80501:  On and before May 24th, 2011, the employer did not ensure each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system in that an employees were engaged in framing operations without fall protection. The condition exposed employees to a fall hazard of approximately 11 feet at the roof's edge near the ladder access.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail systems, warning line system and personal fall arrest system, or warning line system and safety monitoring system:     (a)Walsh Construction, inc. @ 1900 Longs Peak Ave., Longmont, CO 80501: On and before May 24th, 2011, the controlling employer did not ensure that subcontractor employees involved in roofing activites on the Sunset Bath House, working on a 4 in 12 pitched roof, were protected from falling by guardrail systems, safety net systems, or personal fall arrest systems. The subcontractor employees were wearing full body harnesses but were not able to utilize an active conventional fall protection system because the roof anchors had not been installed. The condition exposed employee to a 13' 5" fall hazard on the north side of the roof.

29 CFR 1926.503(a)(1):  The employer did not provide a training program for each employee who might be exposed to fall hazards:    (a) Walsh Construction, Inc.  @ 1900 Longs Peak Ave., Longmont, CO 80501: On and before May 24th, 2011, the controlling employer did not ensure that each employee engaged in framing operations were trained to recognize the hazards of working at elevation and trained in the use of fall protection. Employees engaged in framing activities worked near the edge of a one-story, a 4 in 12 pitched roof on a commercial structure without the use of a fall protection system. This condition exposed employees to a fall in excess of 13 feet.    Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:    (a)  The nature of fall hazards in the work area;    (b)  The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used;    (c)  The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;     (d)  The role of each employee in the safety monitoring system when this system is used;    (e)  The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs;    (f)  The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and    (g)  The role of employees in fall protection plans;    (h)  The standards contained in this subpart.    Abatement Note:  Abatement certification is required for this item (see enclosed Abatement-Certification Letter").    Abatement Note: 1926.503(b)(1) provides that the employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.

29 CFR 1926.1060(a)(1): The employer did not provide a training program for each employee using ladders and stairways which would train each employee in the procedures to be followed to minimize hazards related to ladders and stairways:     (a)Walsh Construction, Inc. @ 1900 Longs Peak Ave., Longmont, CO 80501: On and before May 25th, 2011, the controlling employer did not ensure employees were provided training to recognize hazards related to the use of ladders. The lack of training exposed employees to fall hazards of approximately 11 feet.    Abatement Note: The employer shall ensure that each employee has been trained in the following areas:     (1)  The nature of fall hazards in the work area.     (2)  The correct procedure for erecting and maintaining ladders.      (3)  The proper construction, use, placement, and care in handling of all ladders.     (4)  The maximum intended load capacity of the ladders used by Walsh Construction, Inc.   (5)   The applicable parts of 29 CFR 1926 subpart X.
