29 CFR 1926.451(g)(1):  Each employee on a scaffold 10 feet above a lower level was not protected from falling to the lower level:    (a)  Sunrise Masonry, Inc. at 3509 Xanthia Ct in Denver, CO 80238:  On and before June 4, 2011, the exposing employer did not ensure that employees were protected from a fall from elevation, in that guardrails or other suitable fall protection were not properly installed on the working platforms of the scaffolding. The scaffold used at the front entrance of the residential home lacked midrails and endrails on both the 2nd and 3rd levels of the scaffold. Employees worked from the 2nd and 3rd levels at the project site. This condition exposed employees to falls of approximately 16 feet.    (b)  Sunrise Masonry, Inc. at 3509 Xanthia Ct in Denver, CO 80238:  On and before June 4, 2011, the exposing employer did not ensure that employees were protected from a fall from elevation, in that guardrails or other suitable fall protection were not properly installed on the working platforms of the scaffolding. Employees walked on planking that connected two separate scaffold sections. Toprails, and midrails were not installed at this location on the scaffold. This condition exposed employees to a fall of 16 feet to the ground below.

29 CFR 1926.451(c)(2)(i):  Footings were not level, sound, rigid and capable of supporting the loaded scaffold without settling or displacement:     (a)  Sunrise Masonry, Inc. at 3509 Xanthia Ct in Denver, CO 80238:  On and before June 4, 2011, the exposing employer did not ensure the footings of the fabricated scaffold were secured to prevent displacement. Footings were placed on top of wood mud sills; however, the footings were not secured to the mud sills. Several footings had shifted and were slipping off the mud sills, thus adding instability to the scaffold. This condition exposed employees to falls approximately 16 feet.

29 CFR 1926.454(a):  The employer did not have each employee who performs work while on a scaffold(s) trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffold(s) being used and to understand the procedure(s) to control or minimize those hazards:    (a)  Sunrise Masonry, Inc. at 3509 Xanthia Ct in Denver, CO 80238:  On and before June 4, 2011, the exposing employer did not have each employee who performs work while on a scaffold(s) trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffold(s) being used and to understand the procedure(s) to control or minimize those hazards. Employees worked from the 2nd and 3rd levels at the project site. This condition exposed the employees to a fall of approximately 16 feet due to recognizing the hazards of working on the scaffold.    Abatement Note: The training shall include the following elements at a minimum:    (1)  The nature of any electrical hazards, fall hazards, and falling object hazards in the work area;    (2)  The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used:    (3)  The proper use of the scaffold, and the proper handling of materials on the scaffold;    (4)  The maximum intended load and the load-carrying capacities of the scaffold used; and    (5)  Any other pertinent requirements of this subpart.

29 CFR 1926.454(b): Employees involved in erecting, disassembling, moving, operating, repairing, maintaining or inspecting a scaffold were not trained by a competent person to recognize any hazards associated with the scaffold in question:    (a)  Sunrise Masonry, Inc. at 3509 Xanthia Ct in Denver, CO 80238:  On and before June 4, 2011, the exposing employer did not ensure employees were provided with adequate training concerning erecting, disassembling, moving, operating, repairing, maintaining or inspecting a scaffold. This condition exposed employees to falls of approximately 16 feet.
