29 CFR 1910.176(c): Housekeeping. Storage areas shall be kept free from accumulation of materials that constitute hazards from tripping, fire, explosion, or pest harborage. Vegetation control will be exercised when necessary. Employees were exposed to potential explosion, deflagration or other fire hazards from bag house dust collectors being located inside with deflagration relief panel relief discharge locations within employee occupied areas and from having equipment/ducting located both upstream and downstream of the bag house dust collectors without a method to prevent the propagation of a deflagration occuring within a bag house dust collector to connected equipment/ducting. a) Pellet Mill: Bag house dust collectors #206 and 107-7 which handled combustible chicken manure dust, were located indoors and contained multiple deflagration relief panels having discharge locations within employee occupied areas. b) Pellet Mill: Bag house dust collectors #206 and 107-7, which handled combustible chicken manure dust, lacked a method of deflagration isolation.

OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm. Employees were exposed to the hazards associated with dust explosion, or other fire hazards: a) Barn 1: There was an excessive accumulation of combustible agriculture dust (consisting of chicken dander, feed, etc...) on horizontal surfaces and vertical surfaces such as, but not limited to, the walls, duct work and manure chute curtains. AMONG OTHER METHODS, A FEASIBLE ABATEMENT METHOD TO CORRECT THIS HAZARD is to comply with the National Fire Protection Association (NFPA) NFPA 61 "Standard for the Prevention of Fires and Dust Explosions in Agricultural and Food Processing Facilities," (2008 ed.) Chapter 10-Dust Control; NFPA 654 "Standard for the Prevention of Fire and Dust Explosions from the Manufacturing, Processing, and Handling of Combustible Particulate Solids," (2006 edition) Chapter 8-Fugitive Dust Control and Housekeeping; Factory Mutual Global Property Loss Prevention Data Sheet 7-76, "Prevention and Mitigation of Combustible Dust Explosion and Fire," (March 2009 edition), Section 2.2.4.2-Fugitive Dust and Secondary Explosion Hazards.
