OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that workers were exposed to struck-by hazards.    a)  Hill Manufacturing, Inc. - Wauseon, Ohio: On or about June 14, 2011, an employee was exposed to a nine foot fall hazard when working from a platform that was supported by a forklift.   The employee, being elevated to retrieve materials from the top of an office room, was elevated by a platform that was not equipped with a standard guardrail.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.147(c)(4)(i):     Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:    a) Hill Manufacturing, Inc. - Wauseon, Ohio: On or about June 6, 2011, the employer did not assure that energy control procedures were utilized to control hazardous energy when employees unjammed the BLM Group DYNAM2 tube bending machine (s/n 154040101064).      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.217(f)(2):     Operator(s) were not trained and instructed in the safe method of work before starting work on mechanical power press(es):    a) Hill Manufacturing, Inc. - Wauseon, Ohio: On or about June 15, 2011, the employer did not assure that employees were instructed in safe work methods when operating mechanical power presses.  To facilitate press operation, employees were permitted to stock parts in working areas of the press, exposing employees to struck-by hazards.  An employee was injured when the No. 20 Danly press was cycled at a time in which parts were stocked on the bolster plate.  The stocked parts interfered with the cycle and were ejected from the press.    Per Final Order avd amended to: 29CFR1910.217(h)(13)(ii) Employer failed to have adequate certification on file of employee training.    Employer did not have adequate documentation to show that press operators were informed that they were prohibited from stacking parts on the press during operation.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
