Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to burn, fire and explosion hazards:                              (a) Kitchen- On or about June 27, 2011, the Royal Range was not equipped with a working safety shutoff valve to prevent fires and explosions from occurring.												  Among other methods, one feasible and acceptable way to correct this hazard includes, but not limited to the following:    Conform to the National Fire Protection Association standard, NFPA 86 - Standard for Ovens and Furnaces, 2011 Edition, Chapter 8.8.2 Fuel Gas Safety Shutoff Valves by supplying a functional safety shutoff valve for the fuel gas supply. As well as the Royal Range manufacturer under where it is a standard features, and states "the oven safety valve provides 100% shutdown if the pilot flame goes out."

29 CFR 1910.37(a)(3): Exit route(s) were not kept free and unobstructed:      (a) Kitchen Entrance - Raw material was stored in front of the exit door which leads to the outdoor terrace.       (b) Service/Preparation Area - Bar stools with boxes stored on top were stored in the aisles minimizing the width of the exit route.

(b) Kitchen: Floor was not maintained in a clean condition. Items used for cooking and tubs containing water were observed stored on the floor.

29 CFR 1910.37(b)(2): Each exit was not clearly visible and marked by a sign reading "Exit":    (a) Kitchen - The employer did not mark the door with an "Exit" sign.    In accordance with 29CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.
