29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems:         a)  Fast Framing Inc. at 3452 North Central Park Blvd., Denver, CO 80238:  On or before 7/9/11, the employer did not ensure that employees were protected from falling when framing this 5 unit complex in the following instances:         1)  Each of the five units had a stairway hole on the second floor that not covered or guarded, and the employees were not tied off.  The fall hazard was 21'6"  to the basement;         2)  One stairway hole on the main floor was missing endrails, with a fall hazard of 10'2" to the basement, and the employees were not tied off;         3)  Each of the 5 units had three windows openings measuring 36" above the second floor, with the openings measuring from 3' to 6' wide, and each opening was not guarded, and the employees were not tied off, with exterior fall hazards of about 11';         4)  The employees were working within 6 feet of the edge of the second floor, on multiple units, without fall protection, with fall hazards of about 11'.    Conditions exposed employees to fall hazards of up to 21'6".    Abatement note:  Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Letter").    Abatement note:  Interior holes greater than 12" wide that the employees could step into need to be guarded by horizontal guardrails if the studs are more than 19" apart.  This rule (1926.502(b)(2)(iii)) applies to guarding interior holes, but not to exterior walls.    Abatement note;  The window openings need to be guarded if the lower ledge is less than 39" high from the floor (1926.502(b)(1).
