29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):    (a) EHL Inc., Airport Road & N. Park Ave, Breckenridge, CO 80424:  On and before July 18, 2011, the exposing employer did not ensure that each employee installing a water drain pipe inside an excavation that measured approximately 12-20 feet in height was protected in that the slope was inadequate for Type B soils. This condition exposed employees to a crushing hazards by excavation wall cave-in.    Abatement Note:  Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.20(b)(2):  The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):    a) EHL Inc., Airport Road & N. Park Ave, Breckenridge, CO 80424:  On and before July 18, 2011, the exposing employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Four subcontractor employees were working in a trench excavation behind a retaining wall which backs against a dirt slope without the use of a adequate protective system. The subcontractor employees were installing a water drain pipe. This condition exposed employees to a cave-in hazard.    Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them. 29 CFR 1926.651(c)(2): Each employee in an excavation was not provided a stairway, ladder, ramp or other safe means of egress located in the trench excavation which was 4 feet or more in depth so as to require no more than 25 feet of lateral travel for employees:    (a) EHL Inc., Airport Road & N. Park Ave, Breckenridge, CO 80424:  On and before July 18, 2011, the exposing employer did not ensure that each employee in an excavation was provided a stairway, ladder, ramp or other safe means of egress located in the trench excavation which was 9-12 feet in depth and 280-305 feet in lateral travel. The condition exposed employees to a crushing hazard by excavation wall cave-in. 29 CFR 1926.100(a):  Employees were not protected by hard hats while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects:    (a)  EHL Inc., Airport Road & N. Park Ave, Breckenridge, CO 80424:  On and before July 18, 2011, the employer did not ensure that employees wore hard hats where they could get struck by falling rocks, soil and other material while working inside a trench. This condition exposed employees to head injuries.    Abatement Note:  1926.28(a) also provides that the employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees.
