29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around each hole: (a) EHL, Inc., @ 499 White Cloud, Breckenridge, CO 80424: On and before 2/15/12, the exposing employer did not ensure that the basement access was adequately guarded. Employees utilized a ladder located inside the unfinished stairwell to access the basement. This condition exposed employees to a fall hazard of approximately 12ft.

29 CFR 1926.502(i)(2): All covers were not capable of supporting, without failure, at least twice the weight of employees, equipment, and materials that may be imposed on the cover at any one time: (a) EHL, Inc., @ 499 White Cloud, Breckenridge, CO 80424: On and before 2/23/12, the creating employer did not ensure that an elevator shaft cover was capable of supporting the weight of an exposed employee. The employee suffered injury as a result of falling through the Dow Styrofoam Scoreboard Insulation, which was used to cover the hole, down to the basement below. This condition exposed the employee to a fall hazard of approximately 12ft.
