29 CFR 1926.651(c)(2):  A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees:    a)  Neri Brothers Construction In., did not provide safe means of egress to employees working in a trench with a depth of approximately 6.2 feet.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).      No abatement certification or documentation is required for this item.

29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c):     a)  Neri Brothers Construction, Inc., did not protect each employee in its excavation by sloping the excavation or by using appropriate protective system designed in accordance with paragraphs (b) or (c) of 29 CFR 1926.652.  This violation occurred on July 26, 2011, at 927 Monroe Ave, River Forest, Illinois, where employees were installing a new water main line in an excavation that was approximately 6.2 feet in depth.       Neri Brothers Construction, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in OSHA violation number 313934911, citation 1, item 1b, issued on May 10, 2010 and became final order on or about June 3, 2010 with respect to a workplace located at 17 E. Burlington Ave., Riverside, IL 60546.     No abatement certification or documentation is required for this item.
