29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c):      a)  Neri Brothers Construction, Inc., did not protect each employee in its excavation by sloping the excavation or by using appropriate protective system designed in accordance with paragraphs (b) or (c) of 29 CFR 1926.652.  This violation occurred on April 11, 2012, at the corner of River Road and Eastwood Ave., Schiller park, Illinois, where employees were working in an excavation that was approximately 7.7 feet deep.        Neri Brothers Construction, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in OSHA violation number 92694, citation 2, item 1, issued on September 30, 2011 and became final order on or about October 25, 2011 with respect to a workplace located at 927 Monroe Ave., River Forest, IL 60305.      Neri Brothers Construction, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in OSHA violation number 313934911, citation 1, item 1b, issued on May 10, 2010 and became final order on or about June 3, 2010 with respect to a workplace located at 17 E. Burlington Ave., Riverside, IL 60546.      No abatement certification or documentation is required for this item.
