29 CFR 1910.178(p)(1): \r\n\r\nIf at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition.\r\n\r\nEmployees were exposed to being struck by a Caterpillar LP forklift that was being operated to move tubs and pallets stacked with parts and the back window was broken.

29 CFR 1910.212(a)(1): \r\n\r\nOne or more methods of machine guarding shall be provided to protect the operatorand other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: \r\n\r\nEmployees were exposed to flying pieces of a window, chips of machined parts, and metal cutting fluid because the CNC Lathe SL 400 Machine Number 143, was being operated with a shattered door window.
