29 CFR 1910.95(c)(1): A continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (n) was not instituted when employee noise exposures equaled or exceeded an 8 hour time weighted average sound level (TWA) of 85 dBA: The employer did not establish and maintain a continuing, effective hearing conservation program when an employees exposure to noise exceeded an 8-hour time-weighted average of 85 dBA: One Machinist at machine 145 was exposed to continuous noise at 124.7 % of the action level (8-hour time weighted average sound level of 85 dBA) or an equivalent sound level of approximately 91.6 dBA during the 464 minute sampling period on August 9th, 2011. Exposure calculations included a zero increment for the 16 minutes not sampled.
