Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, to employees in that employees were exposed to combustible agricultural dusts deflagration, explosion or other fire hazards while working at or near dust collectors and associated upstream equipment which were not adequately designed to prevent or minimize employee exposure in the event of a deflagration or other uncontrolled fire event:      a) Kerry Ingredients & Flavours Inc.: On or about July 27, 2011, the employer did not ensure that employees were protected from combustible dust containing flour, cornstarch and other agricultural dust deflagration, explosion or other fire hazards.  The B-4 bag house dust collector was located inside the building and connected to the breading repack line in the Tower Department without a method of (1) explosion protection, (2) fire protection and (3) deflagration isolation devices to upstream processes equipment.     b) Kerry Ingredients & Flavours Inc.: On or about July 27, 2011, the employer did not ensure that employees were protected from combustible dust containing flour, cornstarch and other agricultural dust deflagration, explosion or other fire hazards.  The F-14, Schick, bag house dust collector was located inside the building and connected to the product filling operations in the Batter Department, K5 line, without a method of (1) explosion protection, (2) fire protection and (3) deflagration isolation protection to upstream processes equipment.     c) Kerry Ingredients & Flavours Inc.: On or about July 27, 2011, the employer did not ensure that employees were protected from combustible dust containing flour, cornstarch and other agricultural dust deflagration, explosion or other fire hazards. The F-9, Ultra Industries Inc., bag house dust collector, serial number UCC-3301, was located inside the building and connected to the product fill line for the Batter Department without a method of (1) explosion protection, (2) fire protection and (3) deflagration isolation protection to upstream processes equipment.     Among other methods, a feasible method to correct this hazard would be to comply with fire/deflagration protection for dust collectors in accordance with National Fire Prevention Association (NFPA) 61, "Prevention of Fire and Dust Explosions in Agricultural and Food Processing Facilities, 2008 Ed.",  - Sections 6.3.1. and 10.4.3  NFPA 654 "Standard for the Prevention of Fire and Dust Explosion from Manufacturing, Processing and Handling of Combustible Particulate Solids," 2006 Ed. 7.1.2, 7.1.3, 7.1.4, 7.1.5, 7.13.1.3.1, 7.13.1.5, and 10.
