29 CFR 1926.20(b)(2):     Such programs shall provide for frequent and regular inspections of the job sites, materials, andequipment to be made by competent persons designated by the employers.    On or about 08/02/11 during masonry activities, the employer did not ensure a competent person was available to recognize and abate the following hazards on a fabricated frame scaffold; improper access/egress, fall protection requirements, and the correct placement of planks so as to prevent a cantilever or a situation in which the planking would slip off its end supports.

29 CFR 1926.451(b)(4):   Each end of a platform, unless cleated or otherwise restrained by hooks or equivalent means, shallextend over the centerline of its support at least 6 inches (15 cm).  On or about 08/02/11 during masonry activities, the employer did not ensure planking that was used on the outrigger portion of a fabricated frame scaffold extended over it supports by 6 inches.

29 CFR 1926.451(b)(5)(i):   Each end of a platform 10 feet or less in length shall not extend over its support more than 12inches (30 cm) unless the platform is designed and installed so that the cantilevered portion of the platform is able to support employees and/or materials without tipping, or has guardrails which block employee access to the cantilevered end.   On or about 08/02/11 during masonry activities, the employer did not ensure planking that was used on the outrigger portion of a fabricated frame scaffold did not exceed more than 12 inches over its supports.

29 CFR 1926.451(e)(1):   When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps,walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall beused. Crossbraces shall not be used as a means of access.  On or about 08/02/11 during masonry activities, the employer did not ensure employees did not climb the end frames on a fabricated scaffold while ascending/descending the scaffold.

29 CFR 1926.451(g)(1):   Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.  Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.   On or about 08/02/11 during masonry activities, the employer did not ensure employees were protected from falls by using fall protection systems/devices while working from a fabricated frame scaffold.

29 CFR 1926.454(a):     The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to controlor minimize those hazards. The training shall include the following areas, as applicable:    On or about 08/02/11 during masonry activities, the employer did not ensure employees were trained to recognize and abate the following hazards on a fabricated frame scaffold; improper access/egress, fall protection requirements, and the correct placement of planks so as not to prevent a cantilever or a situation in which the planking would slip off its end supports.
