Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment that were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall hazards: On or about August 2, 2011, an employee was exposed to fall hazards while working from a platform resting on the forks of a forklift because: a) The front side of the platform was not guarded by both a top and mid rail; b) There was no means to securely attach the platform to the lifting carriage or forks, and to prevent the lifting carriage or forks from pivoting forward; and c) The platform did not indicate the maximum work load including personnel and equipment, the weight of the empty platform or the minimum capacity of the truck on which the platform could be used.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use: Employees working with corrosive chemicals were not provided suitable quick drenching facilities: a) Employees on Line 8 operating the button tipper and adjacent equipment were greater than 110 feet from the eyewash and safety shower; b) The eyewash on Line 9 did not dispense clear, particle-free fluid for drenching.
