Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls greater than 10 feet from a forklift platform that was wider than the forklift base: (a) For the employees who were exposed to falls of 23 feet from a man basket that had a width greater than the overall width of the truck measured across the load bearing tires plus 10 inches (250 mm) on either side and was not designed by the equipment manufacturer or a professional engineer on the steel building off of Exit 56, North Interstate 29, South Dakota.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and fuardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system: (a) For the employees who were exposed to falls of 23 feet without a means of fall protection on or about April 27, 2011, who were walking on the completed metal roof and who were working on the eastern edge of the roof of the steel building at Exit 56, North Interstate 29, South Dakota.
