29 CFR 1910.1030(c)(1)(iv)(B): The review and update of the Exposure Control Plan did not document annually consideration and implementation of appropriate commercially available and effective safer medical devices designed to eliminate or minimize occupational exposure: a) At the VA Roseburg Medical Center, the current Bloodborne Pathogen Exposure Control Plan did not include an annual evaluation of safer medical devices such as new injection devices for dentistry and the point of care disposable syringe used in the emergency room. Notice #97010 , Item 1-1, 29 CFR 1910.1030(c)(1)(iv)(B) as required by 29 CFR 1960.8(b) : The employer failed to document annually consideration and implementation of appropriate commercially available and effective safer medical devices. The employer was cited for a violation of the same standard on 10/13/2010, Inspection #312392285, date11/15/2010 of final order/settlement, and means of abatement.

29 CFR 1910.1030(f)(2)(i): Hepatitis B vaccination was not made available after the employee had received the training required in 29 CFR 1910.1030(g)(2)(vii)(I) and within 10 working days of initial assignment to employees who had occupational exposure to blood or other potentially infectious materials unless the employee has previously received the complete hepatitis B vaccination series, antibody testing has revealed that the employee is immune, or the vaccine is contraindicated for medical reasons: a) On or about July 18, 2011 and at times prior thereto, the employer did not ensure that the first dose of hepatitis B vaccination series was administered to covered employees at the facility within 10 working days, or if the employee declined the vaccination, a signed declination was on file. Notice #97010 , Item 1-2, 29 CFR 1910.1030(f)(2)(i) as required by 29 CFR 1960.8(b) : The employer failed to ensure that the first dose of hepatitis B vaccination series was administered to covered employees at the facility within 10 working days, or if the employee declined the vaccination, a signed declination was on file.
