29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from anaerial lift.Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable aspart of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under1926.502(e). At the worksite, the employer did not ensure that employee(s) used harness and lanyard while working from and/or access/exiting a Sunbelt JLG on to and off of a 12' x 12' Church Bell Tower, thereby exposing employee(s) to an approximate 50 foot fall hazard.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a personqualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to controlor minimize those hazards. The training shall include the following areas, as applicable: At the worksite, the employer had not trained employee(s) on the necessary skills to understand and recognize the hazards associated with falls and the requirements on utilizing fall protection when working from an aerial lift.
