29 CFR 1910.23(a)(2):  Every ladder way floor opening or platform shall be guarded by a standard railing with standard toeboard on all exposed sides (except at entrance to opening), with the passage through the railing either provided with a swinging gate or so offset that a person cannot walk directly into the opening.     Production Department - On or about July 20, 2011, a standard railing was not provided on a platform located next to two mixers,  thereby exposing employees to falls.

29 CFR 1910.147(c)(1):  Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.    Throughout facility - On or about July 20, 2011, the employer did not establish an energy control program for employees performing machine set ups and sanitation on Volpi & Son, sheeters model number SMDB-1024, Volpi & Son slitters model number SMNC5-824, and Volpi & Son kneaders, thereby exposing employees to amputation hazards due to the potential for unexpected start up of equipment.

29 CFR 1910.178(l)(1)(i):  The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).    Throughout Facility - On or about July 20, 2011, operators were not trained in the safe operation of powered industrial trucks, thereby exposing all employees in the plant to struck by hazards.

One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation and ingoing nip points.      a. Production Department - On or about July 20, 2011, machine guarding was not in place to protect employees from the blades on the Volpi & Sons dough cutter, model number SMNC5-824, thereby exposing employees to amputation type injuries.    b.  Production Department - On or about July 20, 2011, machine guarding was not in place to protect employees exposed to in-running nip points on the Volpi & Sons dough roller machines, model number SMDB-1024, thereby exposing employees to rotating parts.

29 CFR 1910.219(f)(3):  Sprockets and chains. All sprocket wheels and chains shall be enclosed unless they are more than seven (7) feet above the floor or platform. Where the drive extends over other machine or working areas, protection against falling shall be provided.  This subparagraph does not apply to manually operated sprockets.    Production Department - On or about July 20, 2011, sprocket wheels and chains at or below floor level of the Volpi & Son kneader were not completely enclosed, thereby exposing employees to amputation hazards.
