29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet(1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provisionin paragraph (b) of this section provides for an alternative fall protection measure: (a) Titan Roofing, Inc., 1256 Clarkson Street, Denver, CO 80206: On July 21, 2011, the exposing employer did not ensure that each employees was provided fall protection systems while working on a flat roof performing re-roofing operations on the apartment building. This condition exposed the employees to a fall hazard up to 25 feet to ground.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards to enable employees to reconize the hazards of falling and how to minimize these hazards: (a) Titan Roofing, Inc., 1256 Clarkson Street, Denver, CO 80206: On July 21, 2011, the exposing employer did not ensure that each employee engaged in roofing activities had been trained to recognize the hazards associated with working at elevations over 6 feet. The employees were performing roofing activities on a flat roof of an apartment building without fall protection. This condition exposed employees to the hazard of falling from an elevation of approximately 25 feet. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: (1) The nature of fall hazards in the work area; (2) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; (3) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; (4) The role of each employee in the safety monitoring system when this system is used; (5) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; (6) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and (7) The role of employees in fall protection plans; (8) The standards contained in this subpart.

29 CFR 1926.1053(b)(1): Portable ladders were used to access to an upper landing surface, and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access: (a)Titan Roofing Inc., 1256 Clarkson Street, Denver, CO 80206: On or before July 21, 2011, the exposing empoyer did not ensure that the extension ladder used by the employees to gain access to the roof top was extended at least 3 feet above the roof. This condition exposed employees to the hazard of falling from elevation at a distance of 9 feet to the lower level.
