OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of electrical shock and struck by injuries.      a) Euro Marble & Granite Installations - Yale Electric Hoists, chain slings, and hooks, and pendant controls were not inspected for damage and were not taken out of service until repaired.    Among other methods, one feasible and acceptable means of abatement to correct this hazard is to conform with the requirements of the American Society of Mechanical Engineers for Overhead Hoists (Underhung) - ASME B30.16-2007, Inspection, Testing, and Maintenance, chapter 16-2.1-16-2.1.3., by requiring the implementation of the frequent and periodic inspections for the hoist, ropes and slings.

29 CFR 1910.178(a)(4):     Modifications or additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:    a)  In the Shipping & Receiving and Production & Finishing Department(s)  The Hercules telescoping boom attachment, Model Number CL-640 or CL-641, was used on the Komatsu Powered Industrial Vehicle, without the forklift manufacturers prior written approval.      Note #1:  The employer also modified the Hercules Boom Attachment  as the load bearing capacity placard was defaced on the Hercules Boom equipment and load capacity not visible or available for employees to calculate loads when operating the Komatsu Forklift with the Hercules Boom attachment to lift and transport stone slabs.     Note #2:  The employer also modified the Hercules Boom Attachment - by using the boom without the manufacturers lock and the 3 foot restraining chain with grab hook that should be used to attach to forklift carriage securing the unit onto the forks to prevent the boom from slipping off the forks.

29 CFR 1910.178(a)(5):     The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered:    a) In the Shipping & Receiving and Production & Finishing Department(s)  Employees were required to work from a Komatsu FG-25 Powered Industrial Vehicle, with the Hercules telescoping boom attachment, Model Number CL-640 or CL-641, without the vehicle being marked to identify the combined weight of the vehicle and the attachment at maximum elevation with the load laterally centered.
