Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to combustible dust deflagration, explosion, or other fire hazards of carbon black and graphite mixture while working at or near dust collectors and associated upstream equipment which were not adequately designed to prevent or minimize employee exposure in the event of a deflagration or other uncontrolled fire event: a) Employees were exposed to carbon black and graphite mixture dust deflagration, explosion or other fire hazards from the inside "Torit" cyclone dust collector that lacked means of: (1) explosion protection, (2) deflagration isolation protection to upstream process equipment, and (3) fire protection Among other methods, a feasible method to correct this hazard would be to comply with National Fire Protection Association (NFPA) Standards 654 "Prevention of Fire and Dust Explosions from the Manufacturing, Processing and Handling of Particulate Solids, 2006 Edition" - Sections 7.1.2.1, 7.1.4, 7.1.5, 7.13.1.1.1, 7.13.1.2, 7.13.1.3.1 and 7.13.1.5, and/or to comply with FM Global Property Loss Prevention Data Sheet 7-73 "Dust Collectors and Collection Systems, May 2008" - Sections 2.1.1.1, 2.1.2.2, 2.1.4.2 AND 7-76 "Prevention and Mitigation of Combustible Dust Explosions and Fire, May 2006 - Section 2.4.1.1.
