29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Jobsite: On September 13, 2011 an employee performed framing activities on an exterior top plate without a fall protection system in place. Note 1) Bates Framing, Inc., was previously cited for a violation of this Occupational Safety and Health standard which was contained in OSHA inspection number 313356198, citation 1, item 2, instance b, and was affirmed as a final order on November 2, 2010, with respect to a workplace located at Lot 12, Block 4, Boise ID. Note 2) Bates Framing, Inc., was previously cited for a violation of this Occupational Safety and Health standard which was contained in OSHA inspection number 315028142, citation 1, item 1, and was affirmed as a final order on March 3, 2011, with respect to a workplace located at Lot 3, Block 2 South Shakespeare Way, Boise, ID. Note 3) Bates Framing, Inc., was previously cited for a violation of this Occupational Safety and Health standard which was contained in OSHA inspection number 97450, citation 2, item 1a, and was affirmed as a final order on October 5, 2011, with respect to a workplace located at Lot 3, Block 2 Spur Wing Greens , Meridian, ID. Note 4) Abatement certification is NOT required for this item.
