29 CFR 1926.501(b)(4)(i):     Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.    INSTANCE a: On or about 9/9/11 during construction activities including but not limited to overhand bricklaying on the roof of a third story building with several holes and openings, the employer did not ensure holes were protected to prevent fall hazards approximately 12 feet. The access ladder to the roof was located through the hole and not properly guarded. Two other holes were observed on the roof that were not properly guarded and employees were working in these areas.     INSTANCE b: On or about 9/9/11 during construction activities including but not limited to overhand bricklaying on the roof of a third story building with several holes and openings, the employer did not ensure an elevator shaft hole was protected to prevent fall hazards approximately 55 feet.

29 CFR 1926.502(g)(2)(i):     The controlled access zone shall be defined by a control line erected not less than 10 feet (3.1m) nor more than 15 feet (4.5 m) from the working edge.    On or about 9/9/11 during construction activities including but not limited to overhand bricklaying on the roof of a third story building with several holes and openings, the employer did not ensure the controlled access zone was properly defined by a control line erected not less than 10 feet from the working edge. The control line was erected approximately 5-6 feet away from the working edge.

29 CFR 1926.502(i)(3):     All covers were not secured when installed so as to prevent accidental displacement by the wind, equipment, or employees:    On or about 9/9/11 during construction activities including but not limited to overhand bricklaying on the roof of a third story building with several holes and openings, the employer did not ensure holes were properly protected to prevent fall hazards approximately 12 feet. The holes were observed with covers that were properly marked but none of the covers were secured to prevent accidental displacement.
