29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    a) Ley Construction, LLC on or about September 13, 2011, at the address of 3100 Bay Tree Dr. Findlay, OH: The employer did not ensure employees were protected from falls while installing new roofing material to a residential type structure.  Employees were exposed to a 19ft fall to the ground below.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.    a) Ley Construction, LLC on or about September 13, 2011, at the address of 3100 Bay Tree Dr. Findlay, OH: The employer did not ensure that employees had been trained in the appropriate use of fall protection such as but not limited to the use of personal fall arrest systems or alternative measures while performing various roofing operations.

29 CFR 1926.1053 (b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access.     a) Ley Construction, LLC on or about September 13, 2011, at the address of 3100 Bay Tree Dr. Findlay, OH: The employer did not ensure the side rails of the fiberglass extension ladder were extended at least three feet above the landing. Employees were exposed to falls while using the ladder to access the working level during  roofing activities.
