29 CFR 1926.28(a): The employer is responsible for requiring the wearing of appropriate personal protective equipment inall operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazardsto the employees:    a) Jobsite: On September 17, 2011 and times prior thereto, the responsible person on site did not require and/or enforce the use of protective eyewear when employees were using powered tools, which included nail guns.      Note) Abatement certification IS required for this item.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    a) Jobsite: On September 17, 2011 and times prior thereto employees performed roofing activities on an approximate six in twelve pitched roof without the fall protection harnesses that were worn attached to the lanyard and anchorage point that were installed on the roof.       b) Jobsite: On September 17, 2011 and times prior thereto an employee performed roofing activities on an approximate ten in twelve pitched roof without a fall protection system in place.      Note) Abatement certification IS required for this item.
