29 CFR 1926.252(a): An enclosed chute of wood, or equivalent material, was not used where materials were dropped more than 20 feet to points lying outside the exterior walls of the building(s): On 09/22/11 during residential roof tear off, the employer did not ensure employees used a trash chute when dropping roofing materials from a roof top (which was more than 25 feet in height) into a trailer that was located on the ground and outside building exterior walls.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: A: On 09/22/11 during a residential roof tear off the employer did not ensure employees used fall protection systems/devices; thus exposing employees to falls of greater than 25 feet. B: On 09/29/11 during the installation of a trash chute on a residential roof during roofing activities, the employer did not ensure employees used fall protection systems/devices; thus exposing employees to falls of greater than 25 feet. RCH CONSTRUCTION INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD CFR 1926.501(B)(13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 92291, CITATION NUMBER 01, ITEM NUMBER 01 AND WAS AFFIRMED AS A FINAL ORDER ON 09/29/11, WITH RESPECT TO A WORKPLACE LOCATED AT 7811 HOERTZ RD. PARMA, OHIO 44128. Note: The employer was not following the rescinded residential fall directive STD 03-00-001 or the general residential fall standard concerning fall protection.
