29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):    J.C. Roofing, at 5807 Derry Drive, Fort Collins, CO: On 9/30/11, J.C. Roofing did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person.  J.C. Roofing was replacing a one story tall home's roof.  J.C. Roofing did not perform an inspection of the worksite and equipment to ensure that employees were not exposed to a hazardous work condition.  This condition exposed employees to a fall hazard.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or another provision in paragraph (b) of this section which provides for an alternative fall protection measure:    J.C. Roofing, at 5807 Derry Drive, Fort Collins, CO: On 9/30/11, J.C. Roofing did not ensure that each employee engaged in residential construction activities 6 feet or more above lower levels was protected by guardrail systems, safety net systems, personal fall arrest systems, or another provision in paragraph (b) of this section which provides for an alternative fall protection measure.  J.C. Roofing was replacing a one story tall home's roof.  Approximate height was nine feet four inches above ground level at the roof edge.  Employees were not protected by a guardrail system, safety net system, or personal fall arrest system.  This condition exposed two employees to an approximate nine foot four inch fall hazard.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    J.C. Roofing, at 5807 Derry Drive, Fort Collins, CO: On 9/30/11, J.C. Roofing did not ensure that portable ladders used for access to an upper landing surface and the ladder side rails extended at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access.  J.C. Roofing was replacing a one story tall home's roof.  Employees used a Davidson fiberglass ladder to access the roof.  The ladder rested against the slope of the roof edge.  The ladder side rails extended approximately 1.5 feet above the upper landing surface.  The employer did not ensure the ladder side rails extended at least 3 feet above the upper landing surface.  This condition exposed two employees to an approximate twelve foot fall hazard.

Roofing, at 5807 Derry Drive, Fort Collins, CO: On 9/30/11, J.C. Roofing did not ensure that ladders placed in a location where they could be displaced by workplace activities or traffic, such as in passageways, doorways, or driveways, were secured to prevent accidental displacement, nor was a barricade used to keep the activities or traffic away from the ladder.  J.C. Roofing was replacing a one story tall home's roof.  Employees used a Davidson fiberglass ladder to access the roof.  The ladder rested against the slope of the roof edge.
