29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): Affordable Roofing Inc, at 5811 Auburn Avenue, Fort Collins, CO: On and preceding 9/30/11, Affordable Roofing Inc did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person. Affordable Roofing Inc directed Garcia's Roofing to replace a two story tall home's roof. Garcia's Roofing did not utilize fall protection for its employees. Garcia's Roofing utilized a ladder to access the second story roof from the first story roof that was not secure and stable. Affordable Roofing Inc did not perform an inspection of the worksite and equipment to ensure that employees of Garcia's Roofing were not exposed to a hazardous work condition. This condition exposed employees of Garcia's Roofing to fall hazards. Affordable Roofing Inc, was previously cited for a violation of this Occupational Safety and Health Administration Standard, 29 CFR 1926.20(b)(2), which was contained in Item 1 of Citation 1 issued on August 27, 2009 (OSHA Inspection number 313412496).

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or another provision in paragraph (b) of this section which provides for an alternative fall protection measure: Affordable Roofing Inc, at 5811 Auburn Drive, Fort Collins, CO: On 9/30/11, Affordable Roofing Inc did not ensure that each employee engaged in residential construction activities 6 feet or more above lower levels was protected by guardrail systems, safety net systems, personal fall arrest systems, or another provision in paragraph (b) of this section which provides for an alternative fall protection measure. Employees of Garcia's Roofing worked upon the two story tall home's roof. Employees of Garcia's Roofing were not protected by a guardrail system, safety net system, or personal fall arrest system. Affordable Roofing Inc did not ensure that Garcia's Roofing utilized fall protection. This condition exposed employees of Garcia's Roofing to an approximate twenty foot fall hazard.
