29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor was an alternative fall protection measure provided.      (a)Lazaro's Roofing, LLC @ 3204 Tabernash Dr., Loveland, CO 80534: On and before October 1st, 2011, the exposing employer did not ensure that fall protection systems were utilized by employees engaged in roofing activities while working at the unprotected edges of a roof on a single-family home. Employees were not utilizing a fall protection system. Employees were exposed to fall hazards of approximately 10'.    Lazaro's Roofing, LLC was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926.20(b)(2) which was contained in OSHA Inspection Number 313412488, Citation Number 1, Item 1 issued on September 3rd, 2009, and became Final Order on October 23rd, 2009, with respect to a workplace located at 2121 Redhead Ct., Johnstown, CO 80534.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):     (a)Lazaro's Roofing, LLC  @ 3204 Tabernash Dr., Loveland, CO 80538:  On and before October 1st, 2011, the exposing employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees on-site were permitted to work in areas where fall hazards existed. The condition exposed subcontractor employees to fall hazards of approximately 10 feet.    Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
